High Court finds fault over Chandrababu's arrest in Visakhapatnam, orders DGP to file an affidavit

The High Court on Friday, which heard the lunch motion petition filed by TDP against the arrest of former chief minister Chandrababu Naidu who is on his Praja Chaitanya Yatra tour of Vizianagaram has questioned the governments how they could arrest the person who is staging a protest peacefully.

Former TDP MLA Tenali Sravan Kumar has filed a Lunch Motion petition in the High Court while Krishna Reddy argued on behalf of the petitioner. The petitioner has brought to the notice of court about the several incidents that have occurred in the state since 2019 such as not giving permission for public meetings, imposing conditions on opposition leaders. Chandrababu was taken into custody in the under section 151.

Responding to this, the court asked why the notice was issued under 151 CRPC despite police not have the authority. The court ordered DGP and Visakhapatnam Commissioner of police to file an affidavit to this extent. It asked DGP to file an affidavit in person and adjourned the hearing to March 2.
