Man proceeds to Madras HC as ECI unsuccessful to act on a grievance made by him

The Madras high court was approached by a resident of Theni who was seeking direction to the Election Commission of India to take action against AIADMK for total damage of the model code of conduct by stating Rs. 1,500 for the assistance to families below the poverty line.

Nevertheless, on Wednesday, when the appeal came up for inquiry, counsel on behalf of the petitioner wanted an adjournment since the counsel on record was not available.

A division bench of Justice S Manikumar and Justice Subramonium Prasad told that the Supreme Court has made it evident that such assurances would not sum up to fraudulent practice and adjourned the petition to Thursday, criticizing the counsel for seeking such adjournments.

The petitioner brought up to the election manifesto of AIADMK released on February 19, in which the party had guaranteed Rs. 1,500 to people below the poverty line, impoverished women, widows, unemployed people and underprivileged people through their bank account every month, if the party is chosen in the upcoming elections.

Part VII of the model code of conduct noticeably states that the election manifesto shall not hold anything objectionable to the principles and ethics manifested in the Constitution and should be constant with the letter and spirit of other provisions of the code, said the petitioner.

The petitioner sought the court to get involved and direct the ECI to act, alleging that the ECI has been unsuccessful to act on a grievance made by him against AIADMK on March 20.
