SC orders 84-year-old rape accused to undergo DNA test
New Delhi: The Supreme Court has ordered to conduct the DNA test of an 84-year-old pensioner accused of raping and fathering a child with a 14-year-old girl. The DNA test has been ordered to learn the paternity of the child born after the 84-year-old allegedly raped the minor.
The accused, booked under the POCSO Act, has been lodged in jail for raping a minor. The accused claimed that he is incapable of sexual intercourse as he is very old. He had filed a bail plea in Kolkata High Court which was rejected.
The West Bengal Police said in its report that there is nothing to establish the man is incapable of sexual activities. The victim had given birth to the child on July 5. Police have already taken samples of the child for a DNA test. The DNA test will be conducted in three weeks.
The accused raped the victim after developing a relationship with her in November 2019.
Congress leader Kapil Sibal, who represented the accused before a bench led by Justice Ashok Bhushan in a bail plea, defended the accused citing his age and medical condition. The West Bengal Police, however, denied that there is any medical condition that forgives him.
Kapil Sibal had also argued that the accused was willing to undergo any medical test to prove his innocence in the rape case.
