Doctor charged with POCSO Act for performing sex change surgery on minor
BENGALURU: A minor who had contracted HIV after undergoing a sex change operation, claimed that the surgery was her personal choice. As doctor who had performed the surgery gets arrested.
Dr Anita Patil, a resident of Kacharakanahalli had approached the High Court because of her fears of arrest by the KR Pet Town Police, Mysuru. The police have booked the doctor with exploiting a trafficked person, caused grievous hurt, kidnapping a minor, forgery and also under the POCSO Act.
The advocate of Dr Anita Patil had sought an anticipatory bail from the HC. He said that nobody forced the boy and the surgery was performed on his own wish. He had also misrepresented that he had attained the age of majority.
The government advocate opposing the bail had argued that the victim was a minor when the surgery was performed on him and which is illegal. The doctor was also a part of the scam along with others and had created fake documents to overcome legal lacuna.
However, the HC found that it was right to grant a bail to the doctor. As it said that, “Upon going through all the material, it can be seen that there are no overt acts alleged as against the present petitioner.Under such circumstances, that too when already charge sheet is said to have been filed, I feel it just and proper that by imposing some stringent conditions, if the petitioner is enlarged on anticipatory bail, it would meet the ends of justice.”
