Balakrishan Rao approached the court after taking up the matter with the city police on February 27. In his complaint Rao alleged that the former MLA from Byculla, Waris Pathan delivered hate speech against Hindu Community, under the instruction from the party chief, while former AAP MLA, Kapil Mishra from Delhi was responsible for 'instigation of violence'. A resident of Jiyaguda, Balakrishan Rao took to the notice of court that he came across a video clipping of Waris Pathan who was speaking at a public meeting at Gulbarga.

"I submit that the hate speech was repeatedly delivered in the presence of party president Asaduddin Owaisi. Such types of speech amount to instigating Muslim community to take law into their hands posing imminent threat and grave danger to sovereignty of the country which was already facing a lot of crisis because of CAA, NPR & NRC," he added. "Further I state that Kapil Mishra of Delhi for instigating violence by delivering hate speech and instigating Hindu community to take law in hands due to which over 40 people lost their lives in communal riots. He led a gathering in support of the CAA in Jafarabad area, after which violence erupted between pro-and-anti-CAA protesters," he held.
