New Delhi: Setting in motion the legal battle against the creation of Telangana, three petitions were filed in the Supreme Court on Monday, challenging the decision of the Centre on the bifurcation of Andhra Pradesh.

A Supreme Court Bench headed by Chief Justice of India P Sathasivam posted the petitions to February 7. The petitions have been filed by former MLA Adusumilli Jayaprakash, BJP member Raghu Ram Krishnam Raju and Visalandhra Mahasabha.

Four petitions against the division of Andhra Pradesh are already pending in the Supreme Court.

The petitions are filed by Paiyavolu Keshav, Galla Sateesh, C M Ramesh and P V Krishnaiah.

Earlier, the Supreme Court had declined to entertain the petitions because it was a decision of the Congress Working Committee (CWC) on July 30, 2013. Subsequently, the Union Cabinet approved it on October 3, set up a GoM and prepared the Telangana Bill, which was referred to the Andhra Pradesh Assembly. The Bill has come back to the Centre, which the government plans to bring it to Parliament.

The petitioners urged the Supreme Court to step in and take cognisance of the matter. The petitions referred to the S R Bommai case judgment of the Supreme Court, in which the Apex Court laid down that federalism is a feature of the Basic Structure of the Constitution. In that case, the federal spirit of the Constitution was violated.

Defects in the Telangana Bill are also being pointed out. It is being claimed that the Telangana Bill referred to the AP Assembly is defective. It is pointed out that it does not have Statement of Aims and Objectives and Financial Memorandum. All such defects are pointed out to drive home the point that the process is flawed and as such it cannot be pushed through.
