In reference to a news Article published in Times of India English Daily dated 10.2.2014, captioned "Wakf Board set to reclaim 2K acres”. The facts are said below.

The Judgment of the of Supreme Court says "once a Wakf is created it cannot be subsequently transferred or extinguish even by the maker of the will”.

The H.E.H. Sir Nawab Mir Osman Ali Khan Nizam Vll made Wakf of 2132 Acres, 38 Guntas, old Survey No.1 mentioned in the Bule Book and new Survey No.99/1 Mamidapally Village. From the time of Ummore-e-Mazhabi Department (Religious Department) from Nizam era till today the said property is listed as a Wakf Property. Patta Pahanies of the said property existed in the name of Nizam. How come the State Government claim that it purchased the said Land from Nizam in 1956 which is totally false without any transaction details.

The State Government took the possession of the said land and allotted at different stages without the knowledge of the Mutawalli and Wakf Board and unilaterally changed the survey no. The details of which are said below.

1. lnternational Airport 1051 Acres 34 Guntas.

2. APllC Andhra Pradesh Industrial Infrastructure Corporation 981 Acres 32 Guntas.

3. Mining, Roads, School, Residential Houses etc 98 Acres and 12 Guntas.

The Mutawalli or the Wakf Board did not object for the allotment. Why ?

In the Gazette published by Andhra Pradesh Government dated 9 February 1989 the 2132 Acres 38 Guntas shows Wakf Board as Mutawalli which is not correct. In the presence of the Mutawalli or Nizam Awqaf Committee how can the Wakf Board claim or take direct control of the above said land? The Nizam Family strongly condemns this. The Wakf Board can only monitor through the Mutawalli.

It is only because of silence and negligence of Mutawalli and Nizam Awqaf Committee the land has fallen into litigation. Taking moral responsibility we strongly demand the Mutawalli , Chairman and the Committee Members to resign if they cannot protect the above said Wakf Property made by the Nizam.
