Jagan gets relief from HC
Y S Jaganmohan Reddy and his wife Y S Bharathi Reddy on Tuesday got relief from the High Court at Hyderabad which directed the Enforcement Directorate (ED) not to seize the deposits and assets related to Bharathi Cements pending the disposal of a stay petition filed in the Appellate Authority.
​Hyderabad: Y S Jaganmohan Reddy and his wife Y S Bharathi Reddy on Tuesday got relief from the High Court at Hyderabad which directed the Enforcement Directorate (ED) not to seize the deposits and assets related to Bharathi Cements pending the disposal of a stay petition filed in the Appellate Authority.
Justice Raja Elango gave this direction while hearing a batch of petitions filed by Jagan, Bharathi, Silicon Builders, Bharathi Cements and Bhagwat Sanniddhi Limited.
The petitioners challenged the actions of ED to seize Fixed Deposits of these companies and individuals.
The High Court Registry had raised objections to the admissibility of these petitions as there was an Appellate Authority to challenge ED decisions and placed the petitions before the judge to decide on admissibility.
Senior counsels S Niranjan Reddy and L Ravichander appearing for the petitioners argued before the judge that they had 45 days to appeal against the order of attachment and in the meanwhile the ED cannot take steps to seize their deposits and bank accounts.
Counsel for ED Suresh Kumar countered arguments by petitioners by saying that the ED was taking these steps after the Adjudicating Authority upheld the preliminary attachment order. The rules would permit such seizures, he said.
The judge ordered the ED not to take any further steps till the stay petition before the Appellate Authority was decided.
He also ordered status quo on the Rs 177 crore already transferred into ED account from the petitioners’ accounts.
He made it clear that this order would not preclude the Appellate Authority from deciding on the stay petition.
