One more legal challenge to the Swiss Challenge mode of awarding contracts by the Andhra Pradesh State government was made on Wednesday in the High Court at Hyderabad by a private firm, M/s Envian Engineers Pvt Ltd. However, the Court directed the firm to furnish its five years annual turnover details and also prove its competency to participate in competitive bidding to develop start-up area in Amaravati under the Swiss Challenge mode.

Justice Challa Kodandaram gave this direction while dealing with the petition by M--s Envian Engineers Pvt Ltd challenging the G.O. No 1, issued by the AP government in January 2017 amending the G.O. No. 170 issued approving the proposal submitted by the Singapore Consortium which was the original project proponent for development of start up area.

The judge wanted the petitioner to prove its seriousness in participating in bidding and also its eligibility to participate in the bid. Appearing for the petitioner company, senior counsel D Prakash Reddy alleged that the government had brought the G.O. amending the notification with an intention to benefit the Singapore Consortium.

He said the government had incorporated a clause which would enable the consortium to revise its original proposal when any of competitive bidders stood as highest bidder, but the highest bidder has no such chance to revise its proposals. The petitioner is therefore seeking an open bidding process, he submitted.
