Hyderabad: A petition challenging the validity of Central Goods and Services Tax (GST) and Telangana Goods and Services Tax has been filed in the High Court at Hyderabad. Notices were issued to the Central and State governments and Chairperson of GST Council and Chief Commissioner of Central Taxes.

The division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice J Uma Devi admitted the writ petition moved by advocates S Raj Kumar and two others. It directed the respondents to file their counter affidavits.

The petitioners informed the court that while they went a restaurant, over and above the actual bill, nine per cent of Central GST and nine per cent of State GST amounting to Rs 69 was collected from them. By levying two separate taxes, the common people are being burdened, they said. They also contended that the taxation powers of Parliament and the State Assemblies were taken away and bestowed the same on a GST Council.

This, they alleged, is against the Constitutional scheme and also against the spirit of federalism enshrined in the Constitution. They also sought refund of the Rs 69 collected from them by the restaurant in the form of GST.

The bench after hearing the arguments directed the respondents, including the Kamat Hotel, to file their counter affidavits and adjourned the case.
