The High Court at Hyderabad has directed senior IAS officer Poonam Malakondaiah, Principal Secretary for Health, Medical and Family Welfare Department in Andhra Pradesh, to appear in person on December 4 and explain as to why the Department was not filing counter affidavit in the Public Interest Litigation petition, filed in 2016, seeking regulation of private health sector and strengthening of public health sector.

The division bench comprising Justice V Ramasubramanian and Justice M Ganga Rao gave this direction on Monday while hearing a PIL petition filed by a journalist K Narender. It had during the previous hearing on October 25, the court gave one last chance to the Principal Secretary to file the counter affidavit by Monday, November 13.

The AP Government Pleader informed the bench that he had communicated to the Principal Secretary in writing the direction given by the Court, but there was no response till date. Angered by this attitude, the bench directed the senior IAS officer to be present in the court at the time of next hearing on December 4.

Telangana Special Government Pleader S Sharat Kumar informed the bench that the Telangana State government was adopting the counter affidavit filed by the Telangana State Medical Council in this case and if there were additional points to be made, it would do so during the arguments.

The counsel for the petitioner objected, stating that the issues raised in the petition pertained to corruption and malpractices and they can be responded to by the government and not the Medical Council. The bench directed the Special GP to give his submission in writing.
