Even as the local Army authority in Secunderabad Cantonment plans to close the Gough Road for civilians starting December 1, 2015, Residential Welfare Associations (RWA) and civil groups are planning to take on the Army. This time around, the civil society is not just asking for the deferment of closure of Army roads but to remove all gates, barriers and walls on all closed roads in the Yapral-Bolarum and AOC areas and drop all plans to close any further roads.

They assert that two Allahabad High Court judgements of 2014 empowering only the Cantonment Boards to close roads along with the framing of Cantonment Act 2006 show that the Army has no power to close roads. The Anti Corruption Enforcement Forum, United Federation of Residents Welfare Association (Alwal) and the Secunderabad Cantonment Board (SCB) members together are planning to challenge the Army authorities.

S Chandrasekhar of Anti Corruption Enforcement Forum said, “The Ministry of Defence clarifications of January 7, 2015 regarding the reopening of roads in Mathura and Allahabad cantonments are a clear indication. Leave alone closure of roads in a phased manner we are now going to challenge even the alternate roads proposal. First, the closure of Lakadavala Gate is illegal and arbitrary as it was done without the board resolution u/s Sec 258 of Cantonment Act 2006.”

Civil Society associations are planning to take out dharnas and meet the SCB, CEO and local Army authorities in the coming days. Twin judgments of Allahabad High Court based on two petitions WP 38989/2014 and WP18086/2014 pertaining to Allahabad and Mathura stated that only the Cantonment Board has powers to close or restrict a road by following the procedure of Section 258.

Why Civil Society is hopeful?

• Following a meeting with civil society representatives of 16 Cantonments in June 2014, the Ministry of Defence clarified on January 7, 2015 to reopen the closed roads in unit lines of Mathura and Allahabad.

• Secunderabad is not an active unit line where active army operations take place, but is a training establishment.

• The Allahabad High Court judgement asserts that only a Cantonment Board has powers to close roads after following procedure of Section 258. All eight board members of the Secunderabad Cantonment Board are against the closure of roads.
