The PIL bench of the High Court at Hyderabad comprising Acting Chief Justice Dilip B Bhosale and Justice A V Sesha Sai on Wednesday refused to stay an order of the government of Telangana in declaring all elected and nominated TRS members of Telangana Legislative Council as ex officio members of the Greater Hyderabad Municipal Corporation (GHMC).

Hyderabad: The PIL bench of the High Court at Hyderabad comprising Acting Chief Justice Dilip B Bhosale and Justice A V Sesha Sai on Wednesday refused to stay an order of the government of Telangana in declaring all elected and nominated TRS members of Telangana Legislative Council as ex officio members of the Greater Hyderabad Municipal Corporation (GHMC).

The bench was dealing with a public interest writ petition filed by Dr Dasoju Sravan Kumar, chief official spokesperson of Telangana Pradesh Congress Committee (TPCC). The petitioner questioned the amendment made to the GHMC Act. Senior counsel Raghunandan appearing for the petitioner pointed out that the government amended the Act by way of an executive order, which is impermissible under law.

He contended that by the virtue of the amendment the political parties and independents would be enabled to move members of Legislative Council from a municipality or municipal corporation to any other municipality or municipal corporation at will, and create a rightful majority, which would be detrimental to democratic processes and encourage horse-trading. Advocate General K Ramakrishna Reddy requested the bench time to file the response of the government.
