Detention under PD Act set aside
A two judge bench of the High Court at Hyderabad comprising Justice Nooty Ram Mohan Rao and Justice Anis on Wednesday allowed a Habeas Corpus questioning the detention of the petitioner’s husband Kishan Singh by an order dated May 12 last year.
Hyderabad: A two judge bench of the High Court at Hyderabad comprising Justice Nooty Ram Mohan Rao and Justice Anis on Wednesday allowed a Habeas Corpus questioning the detention of the petitioner’s husband Kishan Singh by an order dated May 12 last year.
The bench was dealing with a petition filed by Ms Kiran. The detenue was taken into preventive detention on the grounds of being a habitual manufacturer and seller of illicit liquor. The bench accepted the plea that the order was vitiated as the documents relied by the authorities was not communicated to him in the language he knew.
The bench allowed similar petitions of other detenues also. Speaking for the bench Justice Nooty Ram Mohan Rao placed on record his appreciation for P Venugopal, government pleader who argued strenuously supporting the detention.
