The bench of Justice C V Nagarjuna Reddy and Justice G Shyam Prasad told the husband to take his two sons to London to provide them a decent education.

The husband, who has been working in the UK for the past 14 years in a physiotherapy team manager’s job in UK’s National Health Services, had been battling it out in this court for the last six months seeking custody of his sons.

The couple got married in 2009 and his wife accompanied him to London. They became parents to two sons - one born in 2011 and another in 2015. However, the strain in their relationship forayed when the wife lodged a complaint with the London police on May 13, 2017, accusing her husband of domestic violence following which he was arrested.

He was granted bail after 24 hours in judicial custody on the condition he would stay away from his house for four weeks. During this period, the wife returned to her parents’ house in Madanapalle of Chittoor district in Andhra Pradesh.

While the husband filed a divorce petition and sought the custody of his kids, the wife opposed his pleas and even the UK court’s ruling to bring the children back to England stating that the legal proceedings were launched against her after she left the UK and were not binding on her.

After going through the matter in depth, the Hyderabad High Court concluded that the allegations of injuries inflicted by her husband on her and the children were uncorroborated. The Court, holding the future of kids uppermost and also with them being born brought up in the UK, directed the wife to hand over custody of the children to her husband.

The bench granted her rights to visit her home in London and see her children as and when she felt like even though the wife was unwilling to even to avail her visitation rights. The bench directed the husband to deposit Rs 5 lakh with her for this purpose.
