Union Law Minister Ravi Shankar Prasad introduced the Muslim Women (Protection of Rights on Marriage) Bill 2017 seeking the practice of triple talaq to be criminalised in the Parliament today.

Triple Talaq is an Islamic practice that allows men to divorce their wives immediately by stating ‘Talaq’ (divorce) thrice.

What is the Bill about?

The Bill criminalises triple talaq, or oral divorce and has provision for a maximum three-year jail term along with a fine for violators practising this form of divorce.

Divorcee Muslim women are also entitled to seek maintenance and have the custody of their minor children.

The pronouncement of talaq by a person upon his wife, by words, either spoken or written or in electronic form or in any other manner whatsoever, shall be void and illegal.

The Bill will be catered to the entire country except for Jammu and Kashmir.

The offences under the purview of this bill will be cognisable and non-bailable.
