The two judge bench of the High Court at Hyderabad comprising acting Chief Justice Dilip B Bhosale and Justice S V Bhatt on Tuesday dismissed at the admission stage a writ appeal filed by Mirador Commercial Private Ltd on the maintainability of a writ in a contractual matter.

Hyderabad: The two judge bench of the High Court at Hyderabad comprising acting Chief Justice Dilip B Bhosale and Justice S V Bhatt on Tuesday dismissed at the admission stage a writ appeal filed by Mirador Commercial Private Ltd on the maintainability of a writ in a contractual matter.


The contractor sought a direction to restrain the Power Grid Corporation from terminating the contract for a High Power Transmission Line between Aurangabad and Vardha. Earlier a single judge had dismissed the writ petition. Senior Counsel D V Subbaiah appearing for the unsuccessful petitioner pointed out that even in contractual matters, the State agencies must act in a fair and just manner.


Senior counsel appearing for the Corporation however pointed out that the contract itself had been terminated and therefore the question of seeking to restrain the Power Grid from cancelling the contract did not arise.
