Justice P Naveen Rao of the High Court at Hyderabad on Thursday directed officials of the GHMC to personally inspect and report to court the factum of illegal construction near the Macca Masjid in the city. The writ petitioner Sajjida Begum complained that the private respondent Maqdoom Moinuddin and Moghny Maqdoom Mohuiddin were carrying out illegal construction within the prohibited area of the archaeological building.

Hyderabad: Justice P Naveen Rao of the High Court at Hyderabad on Thursday directed officials of the GHMC to personally inspect and report to court the factum of illegal construction near the Macca Masjid in the city. The writ petitioner Sajjida Begum complained that the private respondent Maqdoom Moinuddin and Moghny Maqdoom Mohuiddin were carrying out illegal construction within the prohibited area of the archaeological building.


In a surprising response, counsel for the GHMC argued that the GHMC was not the watchdog of all the illegal constructions in its jurisdiction. Deepak Mishra the counsel for the petitioner pointed out that illegal construction was taking place at 20-4-1200 to 1203 at Lad Bazaar near Charminar abutting the mosque.


He pointed out that the respondents failed to take the permission of the archaeological department and such action violated the Archaeological Monuments Act that prohibits construction within 200 metres of any structure protected by the archaeological department.
