A full bench of the High Court at Hyderabad comprising Acting Chief Justice Dilip B Bhosale, Justice C Praveen Kumar and Justice MSK Jaiswal on Friday ruled that the Chief Judicial Magistrate (CJM) in non-metro cities will carry out the functions of the Chief Metropolitan Magistrate (CMM) under the SARFAESI Act.

A full bench of the High Court at Hyderabad comprising Acting Chief Justice Dilip B Bhosale, Justice C Praveen Kumar and Justice MSK Jaiswal on Friday ruled that the Chief Judicial Magistrate (CJM) in non-metro cities will carry out the functions of the Chief Metropolitan Magistrate (CMM) under the SARFAESI Act.

The bench answered a reference by a division bench. It was pointed out that the Act providing for bankers to take possession of secured properties of persons whose accounts are classified as NPA (Non-Performing-Asset) could move the Chief Metropolitan Magistrate in the metros. The bench clarified that the Chief Judicial Magistrate is equivalent to the Chief Metropolitan Magistrate and thus will carry out his functions in non-metro cities.
