Brijesh panel alone can resolve Krishna waters dispute: Telangana

New Delhi: Senior Counsel for Telangana State government, Vaidyanathan, asserted before the Brijesh Kumar Tribunal, adjudicating the Krishna waters dispute, here on Wednesday that it (Brijesh Kumar Tribunal) alone had the jurisdiction to decide whether the Krishna waters dispute pertained to the two Telugu States or all the four States that utilise its waters.

Continuing Telangana arguments, Vaidyanathan said the AP Reorganisation Act, 2014, would not have mentioned the Tribunal under Section 89 if it were to confine the same to just AP and Telangana. As the Centre argued, if there was no dispute, there was no need to mention the Tribunal at all, he said. As the Tribunal was already existing by the time of bifurcation of the erstwhile State, the Centre had asked it to sort out the issue, he said.

If the Centre were to confine the issue to the Telugu State, it would have brought out a special Act on the lines of Ravi-Beas Act.Now that the issue was pending before the Tribunal, neither the Centre nor the SC had jurisdiction over the same, he argued. Krishna waters dispute was an inter-State dispute and hence the Parliament had enacted the law and hence Section 89 of the Reorganisation Act could be interpreted under Article 4 or Article 262, he said. The Tribunal will continue to hear the arguments on Thursday.
