Union Minister of State for Home Affairs, Hansraj Gangaram Ahir, in his written reply to a question by Dr Boora Narsaiah Goud and Prabhakar Reddy of TRS, here on Tuesday reiterated that any delimitation of Assembly seats in AP and Telangana would be possible only by carrying out an amendment to Article 170 to be brought up in line with Section 26.

New Delhi: Union Minister of State for Home Affairs, Hansraj Gangaram Ahir, in his written reply to a question by Dr Boora Narsaiah Goud and Prabhakar Reddy of TRS, here on Tuesday reiterated that any delimitation of Assembly seats in AP and Telangana would be possible only by carrying out an amendment to Article 170 to be brought up in line with Section 26.

The Governments of Telangana and Andhra Pradesh have requested for increasing the seats in Legislative Assembly from 119 to 153 in Telangana and from 175 to 225 in Andhra Pradesh. The Minister said the issue was taken up with the Ministry of Law & Justice, who in turn sought the opinion of the Attorney General who had observed that as per Article 170(3) of the Constitution, the total number of seats in the Assembly of each State should not be readjusted till after the first Census was published post the year 2026.

Therefore, “unless and until Article 170 is amended to bring up in line with Section 26, the increase in the number of seats cannot be given effect" he said. This reply is consistent with the stand of the Union Home Ministry which had been taking this line whenever the question is posed to it, which is often. The same reply was given in the Rajya Sabha too last week.
