Hyderabad: Taking note of the failure of both Telangana State and Andhra Pradesh State governments in resolving the dispute related to payment of salaries to the employees of Andhra Pradesh Administrative Tribunal (APAT) and for providing its maintenance expenditure,

the High Court at Hyderabad has passed a judicial order directing both the governments to deposit the salary amounts in the population ratio of 58.32 : 41.68 with APAT by 20th of every month.

The maintenance expenditure would be borne entirely by Andhra Pradesh government as the Tribunal is working entirely for Andhra Pradesh.

A division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice A Shankar Narayan passed this order on Tuesday while dealing with a writ petition seeking direction to the governments to ensure payment of salaries to employees of APAT.

The bench during the previous hearing had directed both the Chief Secretaries to have a meeting and thrash out modalities of apportioning of employees of APAT between the two States by December 7 and submit a joint report by December 17.

This order of the court was not implemented although both the Chief Secretaries met on December 5 but could not come to an understanding.

They also failed to submit a joint report to the court and instead gave two separate reports along with minutes of the joint meeting.

Since the minutes were not signed by the two Chief Secretaries, the court refused to take its contents into consideration.

The bench in its order noted that in this tussle between both the governments, it was the Chairman, members and employees of APAT who are forced to suffer, not knowing who would pay their salaries and when.

It then directed both the governments to share the salaries bill as per population ratio and directed Andhra Pradesh Government to foot the maintenance bill as the APAT was exclusively functioning for Andhra Pradesh since November of this year.

It also made it clear that this arrangement would continue till the employees are apportioned between the two States.

Upon the suggestion of Telangana Advocate General K Ramakrishna Reddy, the bench also directed the Union of India to ensure that the apportionment of employees of APAT is done at the earliest.
