New Delhi: Bifurcation of the High Court of Judicature at Hyderabad is going to be a long winding process and an indefinite affair, i.e., unless Chief Minister of AP N Chandrababu Naidu decides otherwise.

The worst fears of Telangana have only come true with the Statement of the Union Minister of State for Law and Justice and Electronics and Information Technology, P P Chaudhary in Rajya Sabha on Friday in response to a question of YSRCP MP V Vijayasai Reddy in this regard.

Vijayasai Reddy sought to know when would the bifurcation take place from the Minister. The Minister replied, "Insofar as Andhra Pradesh Reorganisation Act, 2014 is concerned, it provides for setting up of a separate High Court for the State of Andhra Pradesh.

The Act also provides that once separate High Court for the State of Andhra Pradesh is established, the existing High Court will go to the State of Telangana. Till such time the existing High Court i.e. the High Court of Judicature at Hyderabad will serve as common High Court for the States of Telangana and Andhra Pradesh."

He further stated, "To enable the creation of separate High Court for the State of Andhra Pradesh, THE necessary infrastructure such as Court buildings, quarters for the Judges and officials/staff of the Court has to be created by the State Government in consultation with the High Court of Judicature at Hyderabad."

"The Central Government had requested the Chief Justice of the High Court and the Chief Minister of Andhra Pradesh to take all the necessary steps towards the creation of separate High Court for the State of Andhra Pradesh. Presently, the matter is sub judice at the High Court of Judicature at Hyderabad for the States of Telangana and Andhra Pradesh," he added.

Vijayasai Reddy further sought to know the difference between the provisions of Bihar, Madhya Pradesh and Uttar Pradesh Acts and AP Reorganisation Act as far as setting up of the High Court was concerned and whether a separate legislation was required to set up the High Court and when would the Government of AP be setting up the same.
