Hyderabad: The High Court at Hyderabad has sought to know from the Central government, Telangana State and AP State governments as to what policy they have adopted towards the role of Kazis in getting the poor Muslim girls and women married off to foreigners. It has also sought to know as to what steps are being taken by the governments to prevent the exploitation of poor Muslim girls taking advantage of loopholes in Kazis Act, 1880, and stressed the need for the governments to plug these loopholes.

The Court on its own arraigned Union Law Ministry and Women and Child Welfare Ministry, Telangana State Minorities Welfare Department and Waqf Board, Andhra Pradesh Minorities Welfare Department and Waqf Board as respondents. It also wanted Telangana State Advocate General D Prakash Reddy to assist the Court in this matter.

Justice S V Bhatt gave these directions while hearing two separate Writ petitions challenging the appointment of Sheikh Basha as a Kazi for Darshi Town, Mundlamooru and Kurichedu mandals of Prakasham district, and Sheikh Abdul Kareem as Kazi for Singarayakonda and Ulavapadu mandals of the same district by the Andhra Pradesh government through GOs.

The counsel for the petitioner S A Razakk, in his arguments, brought to the notice of the court several loopholes in the appointment of Kazis and that there is no supervision or clear guidelines. The judge pointed out that although the division bench of this court had suggested to the government 12 years ago to amend the Section 2 of the Kazis Act as it was vague, no steps had been taken till date. He said that many newspapers had highlighted the role of Kazis in getting poor Muslim girls and women married off to foreigners, leading to their severe exploitation. He felt that there was need to take a proper decision regarding the role of Kazis in this background and therefore arraigned the Union and State governments and Waqf Boards as respondents and issued notices. He posted the case to October 30.
